This is one in a series of articles about them. Readers can view an&nbsp;<a href=\"https:\/\/www.ucc.org\/synod-eyes-resolutions-bylaw-changes-from-the-internal-to-the-global\/\" target=\"_blank\" rel=\"noreferrer noopener\">initial summary here<\/a>&nbsp;and find&nbsp;<a href=\"https:\/\/www.generalsynod.org\/proposed-resolutions\/\" target=\"_blank\" rel=\"noreferrer noopener\">full texts at the Synod website<\/a>.<\/em><\/p><\/blockquote>\n\n\n\n<p>Aside from the&nbsp;<a href=\"https:\/\/www.archives.gov\/publications\/prologue\/2011\/winter\/ph-decklogs.html\" target=\"_blank\" rel=\"noreferrer noopener\">1941 attack on Pearl Harbor<\/a>, war may not be the first thing that comes to mind when people think of Hawaii.<\/p>\n\n\n\n<p>Some\u00a0Native Hawaiians in the United Church of Christ are asking people to think again.<\/p>\n\n\n\n<p>They are calling attention to an earlier military action, from 1893. They say it created what amounts to a state of war that never ended \u2014 and needs to end now.<\/p>\n\n\n\n<p>They argue that, because the United States took Hawaii by military overthrow, the U.S. and the state government of Hawaii should be seen as occupying forces.<\/p>\n\n\n\n<p>They make their case in&nbsp;<a href=\"https:\/\/www.generalsynod.org\/wp-content\/uploads\/2021\/03\/Hawaii.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">a proposed resolution<\/a>&nbsp;that calls for an end to \u201c128 years of war\u201d between the U.S. and the Hawaiian Kingdom. It will require a two-thirds vote of Synod delegates to pass.<\/p>\n\n\n\n<p>Its sponsor is the\u00a0<a rel=\"noreferrer noopener\" href=\"https:\/\/ahecchurch.weebly.com\/\" target=\"_blank\">Association of Hawaiian Evangelical Churches<\/a>\u00a0of the UCC. The AHEC consists of\u00a0<a rel=\"noreferrer noopener\" href=\"https:\/\/ahecchurch.weebly.com\/churches.html\" target=\"_blank\">31 historically Native Hawaiian congregations<\/a>\u00a0from across the\u00a0<a rel=\"noreferrer noopener\" href=\"https:\/\/www.hcucc.org\/\" target=\"_blank\">Hawaii Conference<\/a>. Some 80 percent of them were founded before 1893.<\/p>\n\n\n\n<p><strong>Hawaiian Kingdom still exists<\/strong><\/p>\n\n\n\n<p>The resolution\u2019s key points are that the\u00a0<a rel=\"noreferrer noopener\" href=\"https:\/\/www.hawaiiankingdom.org\/\" target=\"_blank\">Hawaiian Kingdom<\/a>\u00a0never ceased to exist, even after its overthrow \u2014 and that there\u2019s unfinished business.<\/p>\n\n\n\n<p>It says the U.S., under President Grover Cleveland,&nbsp;<a href=\"http:\/\/www2.hawaii.edu\/~anu\/pdf\/Exec_Agmt.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">negotiated with the Hawaiian Queen Lili\u2018uokalani<\/a>&nbsp;\u2014 soon after deposing her \u2014 to restore her government to power. Cleveland himself,&nbsp;<a href=\"http:\/\/www.let.rug.nl\/usa\/documents\/1876-1900\/president-clevelands-message-about-hawaii-december-18-1893.php\" target=\"_blank\" rel=\"noreferrer noopener\">in an 1893 address to Congress<\/a>, called the overthrow:<\/p>\n\n\n\n<pre class=\"wp-block-preformatted\"><em>an act of war, committed with the participation of a diplomatic representative of the United States and without authority of Congress. ... A substantial wrong has thus been done which a due regard for our national character as well as the rights of the injured people requires we should endeavor to repair.<\/em><\/pre>\n\n\n\n<p>But the Native Hawaiian government has never returned to power \u2014 even though Cleveland, by a still-valid executive order, called for it to be restored, the resolution says.<\/p>\n\n\n\n<p><strong>Peace treaty sought<\/strong><\/p>\n\n\n\n<p>\u201cUnder international law, the action needed is a signed treaty of peace between the United States of America and the Hawaiian Kingdom government,\u201d said Kalaniakea Wilson. He belongs to\u00a0<a rel=\"noreferrer noopener\" href=\"https:\/\/keolamagazine.com\/spirit\/punas-historic-congregational-churches\/\" target=\"_blank\">Kalapana Maunakea First Hawaiian Congregational Church<\/a>\u00a0in Nanawale, founded in 1823. He will speak to the resolution for AHEC when a committee of Synod delegates reviews it in July. Such a treaty, Wilson said, would be \u201csimilar to the agreement of restoration\u201d between Cleveland and Queen Lili\u2019uokalani\u00a0that was \u201cnot implemented.\u201d<\/p>\n\n\n\n<p>The resolution also notes that&nbsp;<a href=\"https:\/\/d3n8a8pro7vhmx.cloudfront.net\/unitedchurchofchrist\/legacy_url\/11261\/mccollough.pdf?1418437063\" target=\"_blank\" rel=\"noreferrer noopener\">the UCC<\/a>&nbsp;and the&nbsp;<a href=\"https:\/\/www.govinfo.gov\/content\/pkg\/STATUTE-107\/pdf\/STATUTE-107-Pg1510.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">U.S. Congress<\/a>&nbsp;apologized in 1993 for their predecessors\u2019 roles in the overthrow.&nbsp;<a href=\"https:\/\/www.yesmagazine.org\/issue\/american-now\/2002\/02\/01\/old-pain-new-hope\" target=\"_blank\" rel=\"noreferrer noopener\">National and Conference bodies in the UCC followed up by paying millions of dollars in reparations<\/a>, in money and property, to Native Hawaiians.https:\/\/www.youtube.com\/embed\/CF6CaLAMh98?feature=oembed\u201cExposing the American Occupation\u201d is part of the subtitle of this 2019 documentary featuring today\u2019s leaders of the Hawaiian Kingdom.<\/p>\n\n\n\n<p>But Wilson said these have not ended the decades of human costs paid by Native Hawaiians ever since the hostile takeover of their home.<\/p>\n\n\n\n<figure class=\"wp-block-embed is-type-video is-provider-youtube wp-block-embed-youtube wp-embed-aspect-16-9 wp-has-aspect-ratio\"><div class=\"wp-block-embed__wrapper\">\n<span class=\"embed-youtube\" style=\"text-align:center; display: block;\"><iframe loading=\"lazy\" class=\"youtube-player\" width=\"584\" height=\"329\" src=\"https:\/\/www.youtube.com\/embed\/CF6CaLAMh98?version=3&#038;rel=1&#038;showsearch=0&#038;showinfo=1&#038;iv_load_policy=1&#038;fs=1&#038;hl=en-US&#038;autohide=2&#038;wmode=transparent\" allowfullscreen=\"true\" style=\"border:0;\" sandbox=\"allow-scripts allow-same-origin allow-popups allow-presentation allow-popups-to-escape-sandbox\"><\/iframe><\/span>\n<\/div><\/figure>\n\n\n\n<p>\u201cThirty years have passed and there has been no solution to resolve 128 years of war crimes and human rights violations targeting Hawaiian Christians,\u201d he said. \u201cThe Hawaiian people have been struggling to survive in Hawaii, leading in all negative health statistics, homelessness and much more.&nbsp;False apologies and broken promises exacerbate our situation.\u201d<\/p>\n\n\n\n<p>Wilson\u00a0said recent struggles \u201chave built a strong movement for self-governance that has grown stronger.\u201d An example, he said, are\u00a0<a rel=\"noreferrer noopener\" href=\"https:\/\/www.ucc.org\/conflict_of_souls_around_hawai_i_s_sacred_mountain\/\" target=\"_blank\">Native-led efforts to protect a sacred mountain, Mauna Kea<\/a>, \u201cfrom continued desecration\u201d by construction work on a large telescope.<\/p>\n\n\n\n<p><strong>Case for war crimes<\/strong><\/p>\n\n\n\n<p>One immediate step forward, Wilson said, would be for the U.S. government and the State of Hawaii \u201cto cooperate with the\u00a0<a rel=\"noreferrer noopener\" href=\"https:\/\/www.hawaiiankingdom.org\/royal-commission.shtml\" target=\"_blank\">Royal Commission of Inquiry<\/a>.\u201d Formed in 2019, it\u2019s an official body of the Hawaiian Kingdom.<\/p>\n\n\n\n<p>The UCC resolution refers to \u201cwar crimes\u201d that impose \u201chumanitarian and human rights violations daily\u201d on Native Hawaiian people. The Commission of Inquiry is amassing historical and legal evidence\u00a0<a rel=\"noreferrer noopener\" href=\"https:\/\/www.hawaiiankingdom.org\/pdf\/Hawaiian_Royal_Commission_of_Inquiry_(2020).pdf\" target=\"_blank\">to back those charges<\/a>.<\/p>\n\n\n\n<p>For example, the Commission argues that actions such as these \u2014 committed against Native Hawaiians by the U.S., as an occupying power \u2014 are war crimes&nbsp;<a href=\"https:\/\/hawaiiankingdom.org\/warcrimes.shtml\" target=\"_blank\" rel=\"noreferrer noopener\">according to international law<\/a>:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>\u201cUsurpation of sovereignty during occupation\u201d<\/li><li>\u201cDenationalizing the inhabitants of occupied territory,\u201d by, for example, outlawing aspects of Native language and culture<\/li><li>\u201cConfiscation of property\u201d<\/li><\/ul>\n\n\n\n<p><strong>International law &#8220;flagrantly violated&#8221;<\/strong><\/p>\n\n\n\n<p>The AHEC is not alone in the current movement to re-recognize the Hawaiian Kingdom.<\/p>\n\n\n\n<div class=\"wp-block-image\"><figure class=\"alignright size-large is-resized\"><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/hawaiiankingdom.org\/blog\/wp-content\/uploads\/2021\/05\/deZayas-quote.png\" alt=\"\" class=\"wp-image-5115\" width=\"287\" height=\"242\"\/><\/figure><\/div>\n\n\n\n<p>One example is the\u00a0<a rel=\"noreferrer noopener\" href=\"https:\/\/www.ohchr.org\/EN\/pages\/home.aspx\" target=\"_blank\">United Nations Office of the Commissioner for Human Rights<\/a>. Its appointed expert,\u00a0<a rel=\"noreferrer noopener\" href=\"https:\/\/www.ohchr.org\/en\/issues\/intorder\/pages\/alfreddezayas.aspx\" target=\"_blank\">Alfred M. deZayas<\/a>, said in 2018 that the islands are \u201cunder a strange form of occupation by the United States, resulting from an illegal military occupation and a fraudulent annexation.\u201d\u00a0<a rel=\"noreferrer noopener\" href=\"https:\/\/hawaiiankingdom.org\/pdf\/Dr_deZayas_Memo_2_25_2018.pdf\" target=\"_blank\">In a letter to Hawaii\u2019s state judiciary,<\/a>\u00a0he described Hawaii as \u201ca sovereign nation-state in continuity.\u201d<\/p>\n\n\n\n<p>Another is the\u00a0<a rel=\"noreferrer noopener\" href=\"https:\/\/nlginternational.org\/\" target=\"_blank\">National Lawyers Guild<\/a>. \u201cInternational humanitarian law continues to be flagrantly violated with apparent impunity by the State of Hawai\u2018i and its county governments,\u201d it said in a\u00a0<a rel=\"noreferrer noopener\" href=\"https:\/\/nlginternational.org\/newsite\/wp-content\/uploads\/2020\/11\/Letter-from-the-NLG-to-State-of-HI-Governor-.pdf\" target=\"_blank\">November 2020 letter to Hawaii\u2019s governor<\/a>. \u201cThis has led to the commission of war crimes and human rights violations of a colossal scale throughout the Hawaiian Islands.\u201d<\/p>\n\n\n\n<p><strong>&#8220;Stop imposing American law&#8221;<\/strong><\/p>\n\n\n\n<p>The AHEC resolution summarizes this history and these arguments in \u201cwhereas\u201d paragraphs and footnotes. But if the Synod were to pass the resolution as written, it would simply and \u201cstrongly\u201d urge:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Hawaii\u2019s state and county leaders and the U.S. Congress and president to \u201cbegin to comply with international humanitarian law in its prolonged and illegal occupation of the Hawaiian Islands.\u201d<\/li><li>\u201cAll United Nation member states and non-member states to cooperate to ensure the United States complies with international humanitarian law and bring an end to the unlawful occupation of the Hawaiian Islands.\u201d<\/li><\/ul>\n\n\n\n<p>The law of the land \u2014 of the Hawaiian Islands, that is \u2014 is what\u2019s at stake, Wilson said. \u201cThe first step is to stop imposing American municipal laws within Hawaiian territory,\u201d he said, \u201cand, second, begin to administer Hawaiian Kingdom law.\u201d<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Native Hawaiians seek Synod support for sovereignty steps by\u00a0Hans Holznagel\u00a0|\u00a0published on May 17, 2021 The 2021&nbsp;General Synod&nbsp;of the United Church of Christ, meeting July 11-18, will consider 11 resolutions and several bylaw changes.
