{"id":4795,"date":"2019-10-17T02:00:07","date_gmt":"2019-10-17T02:00:07","guid":{"rendered":"https:\/\/hawaiiankingdom.org\/blog\/?p=4795"},"modified":"2019-10-17T11:42:41","modified_gmt":"2019-10-17T11:42:41","slug":"hawaiian-royal-commission-of-inquiry","status":"publish","type":"post","link":"https:\/\/hawaiiankingdom.org\/blog\/hawaiian-royal-commission-of-inquiry\/","title":{"rendered":"Hawaiian Royal Commission of Inquiry"},"content":{"rendered":"\n<p>In response to over a century of the United States\u2019 violations of international humanitarian law and the commission of war crimes with impunity that have occurred within the territory of the Hawaiian Kingdom, the <em>acting<\/em> Council of Regency established the Royal Commission of Inquiry (Commission), by <strong><a href=\"https:\/\/hawaiiankingdom.org\/pdf\/Proc_Royal_Commission_of_Inquiry.pdf\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">proclamation<\/a><\/strong>, on April 17, 2019. The Commission was established by \u201cvirtue of the prerogative of the Crown provisionally vested in [the Council of Regency] in accordance with Article 33 of the 1864 Constitution, and to ensure a full and thorough investigation into the violations of international humanitarian law and human rights within the territorial jurisdiction of the Hawaiian Kingdom.\u201d <\/p>\n\n\n\n<p>The Commission\u2019s mandate \u201cshall be to\ninvestigate the consequences of the United States\u2019 belligerent occupation,\nincluding with regard to international law, humanitarian law and human rights,\nand the allegations of war crimes committed in that context\u201d\u2014Article 1(2). &nbsp;To accomplish this mandate, Dr. David Keanu\nSai\u201d\u2014Article 1(1), who currently serves as Minister of the Interior and\nMinister of Foreign Affairs <em>ad interim<\/em>, shall head the Commission and\nhas been authorized to seek \u201crecognized experts in various fields\u201d\u2014Article 3,\nwhose opinions shall form the basis of the Commission\u2019s reports. <\/p>\n\n\n\n<p>The Commission shall first come out with a\npreliminary report that will provide the \u201cgeographical scope and time span of\nthe investigation\u201d\u2014Article 1(2), and the identification of the specific war\ncrimes to be investigated as well as a list of human rights recognized during\nbelligerent occupations. The preliminary report will be followed by periodic\nreports that will identify the perpetrators of these war crimes and human\nrights violations. These periodic reports will have the evidential basis of <em>mens\nrea<\/em> and <em>actus reus<\/em> that have a direct nexus to the elements that\nconstitute a particular war crime(s) as provided in the legal opinion of\nProfessor William Schabas. War crimes have no statute of limitations, and, for\nthose war crimes that are recognized under customary international law, States\nare obligated to prosecute perpetrators of war crimes under its universal\njurisdiction.&nbsp; <\/p>\n\n\n\n<p>These reports \u201cwill be presented to the\nCouncil of Regency, the Contracting Powers of the 1907 Hague Convention, IV,\nrespecting the Laws and Customs of War on Land, the Contracting Powers of the\n1949 Geneva Convention, IV, relative to the Protection of Civilian Persons in\nTime of War, the Contracting Powers of the 2002 Rome Statute, the United\nNations, the International Committee of the Red Cross, and the National Lawyers\nGuild\u201d\u2014Article 1(3).<\/p>\n\n\n\n<p>The Commission has been convened with experts\nin international law in the fields of State continuity, humanitarian law, human\nrights law and self-determination of a people of an existing State under belligerent\noccupation. These experts authored legal opinions for the Commission, which include:\nProfessor Matthew Craven, University of London SOAS, School of Law; Professor\nWilliam Schabas, Middlesex University London, School of Law; and Professor\nFederico Lenzerini, University of Siena (Italy), Department of Political and\nInternational Sciences.
