{"id":4487,"date":"2018-10-11T02:57:32","date_gmt":"2018-10-11T02:57:32","guid":{"rendered":"https:\/\/hawaiiankingdom.org\/blog\/?p=4487"},"modified":"2018-10-11T03:02:33","modified_gmt":"2018-10-11T03:02:33","slug":"ruggles-puts-hawaii-state-judges-on-notice-for-appearing-to-commit-war-crimes-in-foreclosure-proceedings","status":"publish","type":"post","link":"https:\/\/hawaiiankingdom.org\/blog\/ruggles-puts-hawaii-state-judges-on-notice-for-appearing-to-commit-war-crimes-in-foreclosure-proceedings\/","title":{"rendered":"Ruggles Puts Hawai\u2018i State Judges on Notice for Appearing to Commit War Crimes in Foreclosure Proceedings"},"content":{"rendered":"<p><strong>Informs judges that foreclosure proceedings appear to be in violation of Article 46 of the Hague Convention, IV and Article 47 of the 1949 Geneva Convention, IV<\/strong><\/p>\n<p><a href=\"https:\/\/jenruggles.com\/\"><img loading=\"lazy\" decoding=\"async\" class=\"alignleft wp-image-4406\" src=\"https:\/\/hawaiiankingdom.org\/blog\/wp-content\/uploads\/2018\/08\/Jen-Ruggles.jpeg\" alt=\"\" width=\"194\" height=\"233\" \/><\/a>Council member Ruggles released a\u00a0<a href=\"https:\/\/jenruggles.com\/wp-content\/uploads\/Ltr_to_Judge_Ashford_9_23_18.pdf\" target=\"_blank\" rel=\"noopener\">letter<\/a>\u00a0today that she says she sent to all Hawai\u2018i Circuit Court judges meant to advocate on behalf of protected persons in foreclosure proceedings.<\/p>\n<p>Ruggles says \u201cArticle 46 of the Hague Convention IV provides that \u2018Private property cannot be confiscated,\u201d and article 47 of the Geneva Convention IV provides, \u201cPillage is formally forbidden.\u201d<\/p>\n<p>Ruggles referred to the United Nations Human Rights Independent Expert, Dr. Alfred deZaya\u2019s\u00a0<a href=\"https:\/\/jenruggles.com\/wp-content\/uploads\/Dr_deZayas_Memo_2_25_2018.pdf\" target=\"_blank\" rel=\"noopener\">memorandum<\/a>\u00a0that\u00a0had been sent to Hawaii State Judges in February of this year that stated, \u201cThe State of Hawaii courts should not lend themselves to a flagrant violation of the rights of the land title holders and in consequence of pertinent international norms. Therefore, the courts of the State of Hawaii must not enable or collude in the wrongful taking of private lands, bearing in mind that the right to property is recognized not only in U.S. law but also in Article 17 of the Universal Declaration of Human Rights\u2026\u201d<\/p>\n<p>Ruggles wrote that \u201cThe \u2018wrongful taking of private lands\u2019 by lenders, through the circuit courts of the State of\u00a0Hawai\u2018i under foreclosure proceedings, appears to be the war crime of pillaging and that the courts appear to be complicit in a war crime by enabling and colluding \u2018in the wrongful taking of private lands.\u2019<\/p>\n<p>Before lenders loan money they require the borrower to mortgage their real estate as collateral to secure the repayment of the loan. In order for the lender to accept the mortgaged property as collateral, the lender requires the borrower to also purchase a loan title insurance policy for the protection of the lender. The title insurance covers the full debt owed under the promissory note.<\/p>\n<p>\u201cAs an agent for the United States I am bound \u2018to ensure respect for the Convention in all circumstances,\u2019 and, therefore, call upon you to cease and desist \u2018in the wrongful taking of private lands\u2019 from protected persons that are under foreclosure,\u201d Ruggles wrote, \u201cthe lender is protected under the loan title insurance policy that was purchased by the borrower as a condition of the loan.
