{"id":4439,"date":"2018-09-08T01:03:11","date_gmt":"2018-09-08T01:03:11","guid":{"rendered":"http:\/\/hawaiiankingdom.org\/blog\/?p=4439"},"modified":"2018-09-09T20:18:22","modified_gmt":"2018-09-09T20:18:22","slug":"big-island-video-news-bivn-hawaiian-kingdom-supporters-tell-council-cease-desist","status":"publish","type":"post","link":"https:\/\/hawaiiankingdom.org\/blog\/big-island-video-news-bivn-hawaiian-kingdom-supporters-tell-council-cease-desist\/","title":{"rendered":"Big Island Video News (BIVN): Hawaiian Kingdom Supporters Tell Council \u201cCease &#038; Desist\u201d"},"content":{"rendered":"<p><iframe loading=\"lazy\" src=\"https:\/\/www.youtube.com\/embed\/PbdhMEgUwfk\" width=\"779\" height=\"438\" frameborder=\"0\" allowfullscreen=\"allowfullscreen\"><\/iframe><\/p>\n<p><a href=\"http:\/\/www.bigislandvideonews.com\/2018\/09\/06\/video-hawaiian-kingdom-supporters-tell-council-cease-desist\/\" target=\"_blank\" rel=\"noopener\"><strong>HILO, Hawaii &#8211; There was a wave of support on Wednesday for Puna councilwoman Jen Ruggles and her decision to refrain from legislating until county lawyers can provide a proper legal opinion.<\/strong><\/a><\/p>\n<p><strong>(BIVN)<\/strong>\u2013 In lengthy public testimony before the Hawaii County Council meeting got underway in Hilo on Wednesday, Hawaiian Kingdom supporters spoke out in support of absent councilwoman Jen Ruggles, and demanded the council \u201ccease and desist\u201d legislative activity.<\/p>\n<p>Ruggles\u2019 seat was empty as the councilmember from Puna announced she would \u201crefrain from legislating\u201d until the county\u2019s corporation counsel can provide a \u201cproper legal opinion\u201d that will assure her that she \u201cis not incurring criminal liability under international humanitarian law and U.S. law.\u201d<\/p>\n<p>Ruggles\u2019 recent\u00a0<strong><a href=\"http:\/\/www.bigislandvideonews.com\/2018\/08\/29\/councilwoman-ruggles-unassured-by-county-regarding-war-crimes\/\" target=\"_blank\" rel=\"noopener\">decision<\/a>\u00a0<\/strong>was not on the Wednesday\u2019s council agenda for discussion, so testifiers seeking to support Ruggles\u2019 position spoke on other matters, such as Bill 160 \u2013 a measure that amends the County Code of Ethics by requiring that officials \u201cprovide accurate and factual information to the public\u201d to the best of their knowledge.<\/p>\n<p>Public testifiers \u2013 both Hawaiian Kingdom subjects as well as American citizens \u2013 identified themselves as protected persons as defined under Article 4 of the 1949 Fourth Geneva Convention. Many read from similarly worded written testimony.<\/p>\n<p>\u201cI too have come to learn that the Hawaiian Kingdom continues to exist as an independent and sovereign State that has been under an illegal and prolonged occupation by the United States since January 17, 1893,\u201d stated Kale Gumapac, who testified in Hilo. \u201cI am also aware that the United Nations Independent Expert Dr. Alfred deZayas sent a memorandum to members of the State of Hawai\u2018i judiciary which stated \u2018international laws (the Hague and Geneva Conventions) require that governance and legal matters within the occupied territory of the Hawaiian Islands must be administered by the application of the laws of the occupied state (in this case, the Hawaiian Kingdom), not the domestic laws of the occupier (the United States).\u2019 And according to Amnesty International, war crimes are crimes that violate the laws or customs of war defined by the Hague and Geneva Conventions.\u201d<\/p>\n<p>\u201cArticle 43 of the Hague Regulations and Article 64 of the Fourth Geneva Convention obligates the United States to administer Hawaiian Kingdom law, not United States law,\u201d Gumapac continued. \u201cThis deliberate in failure by the United States to administer Hawaiian kingdom law has led to grave breaches under Article 147 of the Fourth Geneva Convention and international humanitarian law. which constitutes war crimes committed against me as a protected person.\u201d<\/p>\n<p>Gumapac finished with a statement that was often repeated by others speakers on Wednesday. \u201cThis body illegally enacts United States laws in violation of the Hague and Geneva Conventions and as a victim of war crimes that stem from this unlawful legislation, I demand that this body immediately cease and desist,\u201d Gumapac said.<\/p>\n<p>Multiple testifiers spoke for roughly two hours before the Hawaii County Council closed public comment and went ahead with the scheduled agenda.<\/p>\n<p>#ProtectedPersonsHawaii<br \/>\n#WarCrimesHawaii<\/p>\n","protected":false},"excerpt":{"rendered":"<p>HILO, Hawaii &#8211; There was a wave of support on Wednesday for Puna councilwoman Jen Ruggles and her decision to refrain from legislating until county lawyers can provide a proper legal opinion.
