Hawaiian Kingdom<\/em><\/a> arbitration held under the auspices of the Permanent Court of Arbitration (1999-2001) were initiated under a <a href=\"http:\/\/hawaiiankingdom.org\/pdf\/Special_Agmt_1_19_17.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">Special Agreement<\/a> dated January 19, 2017. The title for these proceedings is &#8220;Incidents of War Crimes in the Hawaiian Islands\u2014The Larsen Case.&#8221;<a href=\"https:\/\/hawaiiankingdom.org\/blog\/international-commission-of-inquiry-proceedings-initiated-at-the-permanent-court-of-arbitration\/\" target=\"_blank\" rel=\"noopener noreferrer\"><br \/>\n<\/a><\/p>\n<p><iframe loading=\"lazy\" src=\"https:\/\/player.vimeo.com\/video\/211044338?dnt=1&amp;app_id=122963\" width=\"584\" height=\"329\" frameborder=\"0\" allow=\"autoplay; fullscreen; picture-in-picture; clipboard-write\"><\/iframe><\/p>\n<p><a href=\"https:\/\/hawaiiankingdom.org\/blog\/international-commission-of-inquiry-proceedings-initiated-at-the-permanent-court-of-arbitration\/\" target=\"_blank\" rel=\"noopener noreferrer\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter wp-image-3899 size-medium\" src=\"https:\/\/hawaiiankingdom.org\/blog\/wp-content\/uploads\/2017\/01\/Larsen-v.-Hawaiian-Kingdom-Jan-30-evening-flyer-541x700.jpg\" alt=\"\" width=\"541\" height=\"700\" srcset=\"https:\/\/hawaiiankingdom.org\/blog\/wp-content\/uploads\/2017\/01\/Larsen-v.-Hawaiian-Kingdom-Jan-30-evening-flyer-541x700.jpg 541w, https:\/\/hawaiiankingdom.org\/blog\/wp-content\/uploads\/2017\/01\/Larsen-v.-Hawaiian-Kingdom-Jan-30-evening-flyer-768x994.jpg 768w, https:\/\/hawaiiankingdom.org\/blog\/wp-content\/uploads\/2017\/01\/Larsen-v.-Hawaiian-Kingdom-Jan-30-evening-flyer-791x1024.jpg 791w, https:\/\/hawaiiankingdom.org\/blog\/wp-content\/uploads\/2017\/01\/Larsen-v.-Hawaiian-Kingdom-Jan-30-evening-flyer-232x300.jpg 232w, https:\/\/hawaiiankingdom.org\/blog\/wp-content\/uploads\/2017\/01\/Larsen-v.-Hawaiian-Kingdom-Jan-30-evening-flyer.jpg 816w\" sizes=\"auto, (max-width: 541px) 100vw, 541px\" \/><\/a><\/p>\n<p>On March 3, 2017, Professor <a href=\"http:\/\/www.eui.eu\/DepartmentsAndCentres\/Law\/People\/Professors\/Francioni.aspx\" target=\"_blank\" rel=\"noopener noreferrer\">Francesco Francioni<\/a> was designated by the parties by a <a href=\"http:\/\/hawaiiankingdom.org\/pdf\/Supp_Agmt_3_3_17.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">supplemental agreement<\/a> to be the appointing authority, whose function is to form the International Commission of Inquiry. Professor Francioni is an ad hoc judge on the <a href=\"https:\/\/www.itlos.org\/en\/top\/home\" target=\"_blank\" rel=\"noopener noreferrer\">International Tribunal for the Law of the Sea<\/a> as well as serving as one of five arbitrators in a dispute under the auspices of the Permanent Court of Arbitration, <em><a href=\"https:\/\/pcacases.com\/web\/view\/117\" target=\"_blank\" rel=\"noopener noreferrer\">The &#8220;Enrica Lexie&#8221; Case<\/a><\/em> (Italy v. India). The parties notified the appointing authority that the prospective commissioners shall not United States citizens; must have command of the English language; have expertise in international humanitarian law; and include, at least, one woman.<\/p>\n<p>Article I of the <a href=\"http:\/\/hawaiiankingdom.org\/pdf\/Special_Agmt_1_19_17.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">Special Agreement<\/a> was <a href=\"http:\/\/hawaiiankingdom.org\/pdf\/Amend_Agmt%203_26_17.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">amended<\/a> by the parties on March 26, 2017 to allow the Commission to designate\u00a0a Secretary General to serve as a registry, and for the President of the Commission to work with the Secretary General in order to determine a location for the sitting of the Commission.
