The <a href=\"http:\/\/www.royal.gov.uk\/\" target=\"_blank\">British Monarch<\/a> is the Head of State and the Canadian <a href=\"http:\/\/pm.gc.ca\/eng\/prime-ministers\" target=\"_blank\">Prime Minister<\/a> is the Head of Government. Canada received its dominion status in 1867 under the <em><a href=\"http:\/\/en.wikipedia.org\/wiki\/Constitution_Act,_1867\">Constitution Act<\/a><\/em> enacted by the British Parliament. This Act provided self-government for Canada while the British Monarch remained the Head of State represented by a\u00a0<a href=\"https:\/\/www.gg.ca\/index.aspx\">Governor General<\/a>. Today the <em>Constitution Act<\/em> of 1867 forms the basis of Canada\u2019s constitution.<\/p>\n<p><a href=\"https:\/\/hawaiiankingdom.org\/blog\/war-crimes-and-the-canadian-authorities\/canada_flag\/\" rel=\"attachment wp-att-3129\"><img loading=\"lazy\" decoding=\"async\" class=\"alignleft  wp-image-3129\" src=\"https:\/\/hawaiiankingdom.org\/blog\/wp-content\/uploads\/2015\/05\/Canada_flag-700x358.jpg\" alt=\"Canada_flag\" width=\"262\" height=\"138\" \/><\/a><\/p>\n<p>Since 1867, Canada\u2019s treaties with other countries required the countersignature of a British Minister. The first treaty Canada entered into on its own was with the United States in 1923\u2014the Halibut Treaty. Prior treaties that Great Britain entered into with other countries before 1923 applied to Canada if it mentioned the treaties application to British dominions as well as to the United Kingdom.<\/p>\n<p>When the Hawaiian Kingdom entered into a <a href=\"http:\/\/hawaiiankingdom.org\/pdf\/British_Treaty_1851.pdf\" target=\"_blank\">Treaty of Friendship, Commerce and Navigation<\/a> in 1851 with the British, the treaty applied to the United Kingdom and the British Monarch\u2019s dominions, which included Canada. The Hawaiian-British Treaty would also apply to other countries that achieved dominion status, which today is referred to as realm status, include Antigua and Barbuda, Australia, The Bahamas, Barbados, Grenada, Jamaica, New Zealand, Papua New Guinea, St. Christopher and Nevis, St. Lucia, St. Vincent and the Grenadines, Solomon Islands, and Tuvalu. All realm countries recognized the British Monarch as the Head of State.<\/p>\n<p>The Hawaiian-British Treaty is permanent and has no provision for cancellation. Other treaties the Hawaiian Kingdom entered into that have no provisions to terminate and are permanently binding include <a href=\"http:\/\/hawaiiankingdom.org\/pdf\/Annex%2041.pdf\" target=\"_blank\">Denmark<\/a> (1846) and <a href=\"http:\/\/hawaiiankingdom.org\/pdf\/Annex%2046.pdf\" target=\"_blank\">Japan<\/a> (1871).<\/p>\n<p>In 1985, Canada established the Commission of Inquiry on War Criminals \u201cto conduct such investigations regarding alleged [Nazi] war criminals in Canada, including whether any such persons are now resident in Canada and when and how they obtained entry to Canada.\u201d The Commission made recommendations on how to bring war criminals to justice proposed amendments to laws to accomplish this.<\/p>\n<p>By virtue of these recommendations, specialized war crime sections were established in the <a href=\"http:\/\/www.justice.gc.ca\/eng\/\" target=\"_blank\">Department Justice<\/a>, the <a href=\"http:\/\/www.rcmp-grc.gc.ca\/index-eng.htm\" target=\"_blank\">Royal Canadian Mounted Police<\/a> (RCMP), and the <a href=\"http:\/\/www.cic.gc.ca\/english\/\" target=\"_blank\">Citizenship and Immigration Canada<\/a>. In 1998, the <a href=\"http:\/\/www.justice.gc.ca\/eng\/cj-jp\/wc-cdg\/prog.html\" target=\"_blank\">War Crimes Program<\/a> was established as an interdepartmental initiative between these three departments. In 2003, the <a href=\"http:\/\/www.cbsa-asfc.gc.ca\/menu-eng.html\" target=\"_blank\">Canada Border Services Agency<\/a> joined the three.<\/p>\n<p>On December 18, 1998, Canada signed the <a href=\"http:\/\/www.icc-cpi.int\/en_menus\/icc\/Pages\/default.aspx\" target=\"_blank\">International Criminal Court\u2019s<\/a> (ICC) <a href=\"http:\/\/www.icc-cpi.int\/nr\/rdonlyres\/ea9aeff7-5752-4f84-be94-0a655eb30e16\/0\/rome_statute_english.pdf\" target=\"_blank\">Rome Statute<\/a> that reinforced Canada\u2019s commitment to enact further legislation to criminalize war crimes, crimes against humanity, and genocide. In 2000, Canada enacted the <em><a href=\"http:\/\/laws-lois.justice.gc.ca\/eng\/acts\/C-45.9\/\" target=\"_blank\">Crimes Against Humanity and War Crimes Act<\/a><\/em> that authorized Canadian authorities to prosecute war crimes committed on Canadian territory and outside of Canada. If the war crimes are committed on Canadian territory, the jurisdiction is <em>territorial<\/em>. If the war crimes are committed abroad by a Canadian the jurisdiction is <em>active personality principle<\/em>, and if the victim of the war crime is Canadian the jurisdiction is <em>passive personality principle<\/em>. If the war crimes committed abroad have no direct connection to Canada, the jurisdiction is <em>universal principle<\/em>.<\/p>\n<p>The ICC exercises universal jurisdiction with the primary responsibility to prosecute is with countries that signed the Rome Statute, but for cases that will be prosecuted by the ICC, Canada amended its <em><a href=\"http:\/\/laws-lois.justice.gc.ca\/eng\/acts\/M-13.6\/page-3.html#h-7\" target=\"_blank\">Mutual Legal Assistance in Criminal Matters Act<\/a><\/em> (1985) in 2015 to allow Canadian authorities to assist the ICC Prosecutor with their own investigation of persons and the gathering evidence in Canada.<\/p>\n<p><a href=\"https:\/\/hawaiiankingdom.org\/blog\/war-crimes-and-the-canadian-authorities\/rcmp-bldg-1\/\" rel=\"attachment wp-att-3128\"><img loading=\"lazy\" decoding=\"async\" class=\"  wp-image-3128 alignright\" src=\"https:\/\/hawaiiankingdom.org\/blog\/wp-content\/uploads\/2015\/05\/RCMP-Bldg-1-663x700.jpg\" alt=\"RCMP Bldg (1)\" width=\"185\" height=\"195\" srcset=\"https:\/\/hawaiiankingdom.org\/blog\/wp-content\/uploads\/2015\/05\/RCMP-Bldg-1-663x700.jpg 663w, https:\/\/hawaiiankingdom.org\/blog\/wp-content\/uploads\/2015\/05\/RCMP-Bldg-1-284x300.jpg 284w, https:\/\/hawaiiankingdom.org\/blog\/wp-content\/uploads\/2015\/05\/RCMP-Bldg-1.jpg 884w\" sizes=\"auto, (max-width: 185px) 100vw, 185px\" \/><\/a>The RCMP National Division\u2019s <em><a href=\"http:\/\/www.rcmp-grc.gc.ca\/ottawa\/services\/sii-endi-eng.htm\" target=\"_blank\">Sensitive and International Investigations<\/a><\/em> unit is responsible criminal investigations for war crimes.\u00a0The <em>Sensitive and International Investigations<\/em> \u201cis tasked with investigating the activities of suspected war criminals who have sought safe haven in Canada. These investigations require strong collaboration between the\u00a0RCMP\u00a0and our national and international partners, the ability to adapt to various foreign legal systems while respecting their customs and laws, and bringing these convicted war criminals to justice by denaturalizing, deporting or extraditing them.\u201d<\/p>\n<p>This unit works together with the Department of Justice\u2019s <em><a href=\"http:\/\/justice.gc.ca\/eng\/cj-jp\/wc-cdg\/index.html\" target=\"_blank\">Crimes Against Humanity and War Crimes Section<\/a><\/em>. War crimes can be <a href=\"http:\/\/justice.gc.ca\/eng\/cj-jp\/wc-cdg\/prog.html#how\" target=\"_blank\">reported<\/a> to both agencies and both are headquartered in Ottawa, capital city of Canada.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Canada is a constitutional monarchy.
