{"id":3107,"date":"2015-05-14T19:53:16","date_gmt":"2015-05-14T19:53:16","guid":{"rendered":"http:\/\/hawaiiankingdom.org\/blog\/?p=3107"},"modified":"2015-05-14T20:03:48","modified_gmt":"2015-05-14T20:03:48","slug":"war-crimes-on-mauna-kea-reported-to-canadian-federal-authorities","status":"publish","type":"post","link":"https:\/\/hawaiiankingdom.org\/blog\/war-crimes-on-mauna-kea-reported-to-canadian-federal-authorities\/","title":{"rendered":"War Crimes on Mauna Kea Reported to Canadian Federal Authorities"},"content":{"rendered":"<p style=\"text-align: left;\"><a href=\"https:\/\/hawaiiankingdom.org\/blog\/state-of-hawaii-judge-says-he-received-summons-from-the-international-criminal-court\/dexter_kaiama\/\" rel=\"attachment wp-att-2202\"><img loading=\"lazy\" decoding=\"async\" class=\"alignleft  wp-image-2202\" src=\"https:\/\/hawaiiankingdom.org\/blog\/wp-content\/uploads\/2014\/08\/Dexter_Kaiama.jpg\" alt=\"Dexter_Kaiama\" width=\"123\" height=\"130\" \/><\/a>OTTAWA, CANADA \u2013 On May 13, 2015, attorney Dexter Ka\u2018iama reported war crimes of unlawful confinement, deprivation of a fair trial, and destruction of public property to the Department of Justice\u2019s <a href=\"http:\/\/www.justice.gc.ca\/eng\/cj-jp\/wc-cdg\/prog.html#how\" target=\"_blank\"><em>Crimes against Humanity and War Crimes<\/em><\/a><em> section<\/em> and to the Royal Canadian Mounted Police (RCMP) National Division\u2019s <a href=\"http:\/\/www.rcmp-grc.gc.ca\/ottawa\/services\/sii-endi-eng.htm\" target=\"_blank\"><em>Sensitive and International Investigations<\/em><\/a> on behalf of his client, Mr. Kaho\u2018okahi Kanuha. War crimes were alleged to have been committed by TMT International Observatory, LLC, (TMTIO), which has a Canadian partner, the\u00a0Association of Canadian Universities for Research in Astronomy. Canada\u2019s government also recently <a href=\"http:\/\/www.cbc.ca\/news\/technology\/canada-finally-commits-its-share-of-funds-for-thirty-meter-telescope-1.3022659\" target=\"_blank\">committed<\/a> $250 million dollars for the construction of the thirty-meter telescope by TMTIO on Mauna Kea.<\/p>\n<p><span class=\"embed-youtube\" style=\"text-align:center; display: block;\"><iframe loading=\"lazy\" class=\"youtube-player\" width=\"584\" height=\"329\" src=\"https:\/\/www.youtube.com\/embed\/KfU1gZQaLNQ?version=3&#038;rel=1&#038;showsearch=0&#038;showinfo=1&#038;iv_load_policy=1&#038;fs=1&#038;hl=en-US&#038;autohide=2&#038;wmode=transparent\" allowfullscreen=\"true\" style=\"border:0;\" sandbox=\"allow-scripts allow-same-origin allow-popups allow-presentation allow-popups-to-escape-sandbox\"><\/iframe><\/span><\/p>\n<p>Ka\u2018iama requested <a href=\"http:\/\/www2.hawaii.edu\/~anu\/\" target=\"_blank\">Dr. Keanu Sai<\/a>, a political scientist, to draft a <em>War Crimes Report<\/em> to accompany the complaint so Canadian authorities can understand the context of why war crimes are being committed in the Hawaiian Islands. The report affirmatively answers four fundamental questions that underlie Ka\u2018iama\u2019s complaint: <em>first<\/em>, whether the Hawaiian Kingdom existed as an independent State and a subject of international law in the nineteenth century; <em>second<\/em>, whether the Hawaiian Kingdom continues to exist as an independent State and a subject of International Law, despite the illegal overthrow of its government by the United States on January 17, 1893; <em>third<\/em>, whether war crimes have been committed in violation of international humanitarian law; and, <em>fourth<\/em>, whether the Canadian Government is capable of investigating and prosecuting war crimes that occur outside of its territory.<\/p>\n<p>Download the <a href=\"http:\/\/hawaiiankingdom.org\/pdf\/Canadian_Complaint.pdf\" target=\"_blank\"><em>War Crimes Complaint<\/em><\/a>.<br \/>\nDownload the <em><a href=\"http:\/\/hawaiiankingdom.org\/pdf\/Canadian_War_Crimes_Report.pdf\" target=\"_blank\">War Crimes Report<\/a><\/em>.<\/p>\n<p><a href=\"https:\/\/hawaiiankingdom.org\/blog\/war-crimes-on-mauna-kea-reported-to-canadian-federal-authorities\/rcmp-shield\/\" rel=\"attachment wp-att-3111\"><img loading=\"lazy\" decoding=\"async\" class=\"  wp-image-3111 alignright\" src=\"https:\/\/hawaiiankingdom.org\/blog\/wp-content\/uploads\/2015\/05\/RCMP-Shield-700x425.jpg\" alt=\"RCMP Shield\" width=\"280\" height=\"175\" \/><\/a><\/p>\n<p>Due to a court appearance on Maui, Ka\u2018iama was unable to accompany Kanuha to meet with the Canadian authorities. In his stead, Dr. Sai, who is Ka\u2018iama\u2019s law office\u2019s expert consultant on these matters, accompanied Kanuha. In a letter to the Canadian authorities, Ka\u2018iama stated, \u201cDr. Sai is perhaps the foremost qualified expert to answer any questions you may have regarding the case as well as the circumstances of why the Hawaiian Islands are currently under an illegal and prolonged occupation by the United States since the Spanish-American War, 1898, being an international armed conflict as defined under common Article 2 of the 1949 Geneva Conventions.\u201d<\/p>\n<p><a href=\"https:\/\/hawaiiankingdom.org\/blog\/war-crimes-on-mauna-kea-reported-to-canadian-federal-authorities\/kitv-kanuha\/\" rel=\"attachment wp-att-3113\"><img loading=\"lazy\" decoding=\"async\" class=\" size-full wp-image-3113 alignleft\" src=\"https:\/\/hawaiiankingdom.org\/blog\/wp-content\/uploads\/2015\/05\/KITV-Kanuha.jpg\" alt=\"KITV-Kanuha\" width=\"320\" height=\"180\" \/><\/a>\u201cWe met with two Constables who were criminal investigators of the RCMP\u2019s <em>Sensitive and International Investigations<\/em> unit at their headquarters,\u201d said Kanuha. \u201cThey fully understood what we were saying about war crimes and they took it very seriously. At first they were puzzled because they assumed Hawai\u2018i was a part of the United States, but Dr. Sai was able to explain why and how we were occupied since the Spanish American War. Dr. Sai even lightened things up when he asked them if they ever saw the movie Matrix, and after they both said yes, he jokingly told them that they just took the red pill and now they know about Hawai\u2018i\u2019s occupation. Dr. Sai even told the Constables that Keanu Reeves, a Canadian citizen who played Neo in the Matrix, was his cousin.\u201d<\/p>\n<p><span class=\"embed-youtube\" style=\"text-align:center; display: block;\"><iframe loading=\"lazy\" class=\"youtube-player\" width=\"584\" height=\"329\" src=\"https:\/\/www.youtube.com\/embed\/ETf4UhOWAG0?version=3&#038;rel=1&#038;showsearch=0&#038;showinfo=1&#038;iv_load_policy=1&#038;fs=1&#038;hl=en-US&#038;autohide=2&#038;wmode=transparent\" allowfullscreen=\"true\" style=\"border:0;\" sandbox=\"allow-scripts allow-same-origin allow-popups allow-presentation allow-popups-to-escape-sandbox\"><\/iframe><\/span><\/p>\n<p>The war crimes were reported in accordance with the Canadian <a href=\"http:\/\/www.international.gc.ca\/court-cour\/war-crimes-guerres.aspx?lang=eng\" target=\"_blank\"><em>Crimes Against Humanity and War Crimes Act<\/em><\/a> (2000) and international humanitarian law. Ka\u2018iama stated, \u201cI am filing this complaint, on behalf of my client, Mr. Chase Michael Kaho\u2018okahi Kanuha, a Hawaiian subject and protected person, for the war crime of deprivation of liberty when he, along with thirty other individuals, was unlawfully arrested and temporarily detained on April 2, 2015, in the taking of protective measures to prevent the war crime of destruction of public property during occupation to be carried out by TMT International Observatory, LLC, (TMTIO) upon the summit of Hawai\u2018i\u2019s largest mountain Mauna a Wakea, also known as Mauna Kea. Additionally, my client is reporting the war crimes of destruction of public property during occupation committed in the building and erecting of the following thirteen observatories:<\/p>\n<ol>\n<li>University of Hawai\u2018i Institute for Astronomy\u2019s UH telescope built in 1970;<\/li>\n<li>NASA\u2019s Infrared Telescope Facility built in 1979;<\/li>\n<li>CFHT Corporation\u2019s Canada-France-Hawai\u2018i Telescope built in 1979;<\/li>\n<li>UKIRT\u2019s United Kingdom Infrared Telescope built in 1979;<\/li>\n<li>East Asian Observatory\u2019s James Clerk Maxwell Telescope built in 1987;<\/li>\n<li>Caltech Submillimeter Observatory\u2019s telescope (10-meter) built in 1987;<\/li>\n<li>National Radio Astronomy Observatory\u2019s Very Large Baseline Array radio-telescope antennas built in 1992;<\/li>\n<li>M. Keck Observatory\u2019s Keck I telescope built in 1993;<\/li>\n<li>M. Keck Observatory\u2019s Keck II telescope built in 1996;<\/li>\n<li>National Astronomical Observatory of Japan\u2019s Subaru Telescope built in 1999;<\/li>\n<li>Gemini Observatory\u2019s Gemini Northern Telescope built in 1999;<\/li>\n<li>Smithsonian Astrophysical Observatory and the Academia Sinica Institute of Astronomy and Astrophysics of Taiwan\u2019s Submillimeter Array built in 2002;<\/li>\n<li>University of Hawai\u2018i at Hilo\u2019s UH Hilo Educational Telescope built in 2010.\u201d<\/li>\n<\/ol>\n<p>In the complaint, Ka\u2018iama invoked his client\u2019s rights under the 1851 Hawaiian-British Treaty with the filing of this complaint. Article VIII provides, \u201cThe subjects of either of the contracting parties, in the territories of the other, shall receive and enjoy full and perfect protection for their persons and property, and shall have free and open access to the courts of justice in the said countries, respectively, for the prosecution and defense of their just rights; and they shall be at liberty to employ, in all causes, the advocates, attorneys or agents of whatever description, whom they may think proper; and they shall enjoy in this respect the same rights and privileges as native subjects.\u201d The treaty, among other things, provides reciprocal rights to the subjects of the Hawaiian Kingdom and to the subjects of Her Majesty in all of her dominions, which includes Canada.<\/p>\n<p>Download the <a href=\"http:\/\/hawaiiankingdom.org\/pdf\/British_Treaty_1851.pdf\" target=\"_blank\"><em>1851 Hawaiian-British Treaty<\/em><\/a><\/p>\n<p>The treaty is perpetual and has no provisions for termination, except for termination of articles 4, 5, and 6 that apply to duties and trade. According to Dr. Sai, \u201cthe treaty continues to be binding on Her Britannic Majesty in right of Canada or any of its provinces.\u201d In 1893, the Hawaiian Kingdom maintained a Legation in London, a Consul General in Toronto (Ontario), and Consulates in Montreal (Qu\u00e9bec), Belleville (Ontario), Kingston (Ontario), Rimouski (Qu\u00e9bec), St. Johns (Newfoundland and Labrador), Yarmouth (Nova Scotia), Victoria (British Columbia), and Vancouver (British Columbia).<\/p>\n<p>After Ka\u2018ima stated, \u201cIn accordance with the principle that war crimes shall not be treated with impunity, and also pursuant to \u00a7702.1 of Canada\u2019s Unit Guide (1990), which notes that the Geneva Conventions \u2018impose an obligation on all nations which have ratified them to search for and try all persons who committed or ordered to be committed grave breaches of the Conventions,\u2019\u201d he requested \u201cthat an enquiry be instituted by the RCMP\u2019s <em>Sensitive and International Investigations<\/em> concerning the alleged violations of the 1949 Geneva Convention, IV. And, if after careful review the violations have been established, I call upon the Canadian authorities to put an end to the violations and punish those responsible without any possible delay.\u201d<\/p>\n<p>Kanuha said, \u201cThis is not a conflict between culture and science, but rather on procedures that have not complied with international law and the law of occupation. If Hawai\u2018i is legally a part of the United States then there are no war crimes, but if Hawai\u2018i is not then we are forced to deal with the ramifications of this new reality and war crimes that have been committed on Mauna a Wakea. This has been a learning process for me and for many others as well.
