An opinion published by the State of Hawai\u2018i Lieutenant Governor’s Office’s Office of Information Practices<\/a> (OIP) dated November 7, 2014, concluded that the Trustees of the Office of Hawaiian Affairs violated the Sunshine Law<\/a>.\u00a0Willful violation of the Sunshine Law is a misdemeanor. Hawai\u2018i\u00a0misdemeanors are crimes that carry a maximum sentence of no more than one year imprisonment and a fine not exceeding $2,000, and removal from the Board. The opinion was authored by OIP Staff Attorney, Jennifer Z. Brooks.<\/p>\n

\"Dr.-Kamana\u2019opono-Crabbe-OHA\"<\/a>The opinion stems from a letter<\/a>\u00a0by OHA CEO Dr. Kamana\u2018opono Crabbe to U.S. Secretary of State John Kerry<\/a> requesting answers to the following questions.<\/p>\n

\u2022 First, does the Hawaiian Kingdom, as a sovereign independent State<\/a>, continue to exist as a subject of international law?<\/p>\n

\u2022 Second, if the Hawaiian Kingdom continues to exist, do the sole-executive agreements<\/a> bind the United States today?<\/p>\n

\u2022 Third, if the Hawaiian Kingdom continues to exist and the sole-executive agreements are binding on the United States, what effect would such a conclusion have on United States domestic legislation, such as the Hawai\u2018i Statehood Act<\/a>, 73 Stat. 4, and Act 195?<\/p>\n

\u2022 Fourth, if the Hawaiian Kingdom continues to exist and the sole-executive agreements are binding on the United States, have the members of the Native Hawaiian Roll Commission<\/a>, Trustees and staff of the Office of Hawaiian Affairs incurred criminal liability under international law?\u201d<\/p>\n

After the letter was sent, the OHA Trustees lashed out<\/a> at Dr. Crabbe and sought to terminate him for simply asking the questions. This action prompted massive support for Dr. Crabbe amongst the Hawaiian community, which ultimately led to the investigation by the OIP.<\/p>\n
