{"id":1209,"date":"2014-02-04T01:25:08","date_gmt":"2014-02-04T01:25:08","guid":{"rendered":"http:\/\/hawaiiankingdom.org\/blog\/?p=1209"},"modified":"2014-02-15T17:16:39","modified_gmt":"2014-02-15T17:16:39","slug":"hawaii-war-crimes-unlawful-deportation-or-transfer-or-unlawful-confinement","status":"publish","type":"post","link":"https:\/\/hawaiiankingdom.org\/blog\/hawaii-war-crimes-unlawful-deportation-or-transfer-or-unlawful-confinement\/","title":{"rendered":"Hawai\u2018i War Crimes: Unlawful Deportation or Transfer or Unlawful Confinement"},"content":{"rendered":"<p><a href=\"http:\/\/en.wikipedia.org\/wiki\/War_crime\">War crimes<\/a> are actions taken by individuals, whether military or civilian, that violates <a href=\"http:\/\/en.wikipedia.org\/wiki\/International_humanitarian_law\">international humanitarian law<\/a>, which includes the 1907 Hague Conventions, 1949 Geneva Conventions and the Additional Protocols to the Geneva Conventions. War crimes include \u201cgrave breaches\u201d of the 1949 Fourth Geneva Convention, which also applies to territory that is occupied even if the occupation takes place without resistance. <a href=\"http:\/\/www.crimesofwar.org\/a-z-guide\/protected-persons\/\">Protected persons<\/a>\u00a0under International Humanitarian Law are all nationals who reside within an occupied State, except for the nationals of the Occupying Power.\u00a0The\u00a0<a href=\"http:\/\/www.icc-cpi.int\/en_menus\/icc\/Pages\/default.aspx\">International Criminal Court<\/a>\u00a0and States\u00a0prosecute individuals for war crimes.<\/p>\n<p><strong><i>War Crimes: Unlawful deportation or transfer or unlawful confinement<\/i><\/strong><\/p>\n<p>According to the United States Department of Justice, the <a href=\"http:\/\/www.bjs.gov\/content\/pub\/pdf\/p11.pdf\">prison population<\/a> in the Hawaiian Islands in 2009 was at 5,891. Of this population there were 286 <a href=\"http:\/\/www.gao.gov\/new.items\/d11187.pdf\">aliens<\/a>. Two paramount issues arise\u2014first, prisoners were sentenced by courts that were not properly constituted under Hawaiian Kingdom law and\/or the international laws of occupation and therefore were unlawfully confined, which is a war crime; second, the alien prisoners were not advised of their rights in an occupied State by their State of nationality in accordance with the 1963 <i>Vienna Convention on Consular Relations<\/i>. Compounding the violation of alien prisoners rights under the <i>Vienna Convention<\/i>, Consulates located in the Hawaiian Islands were granted <a href=\"http:\/\/en.wikipedia.org\/wiki\/Exequatur\">exequaturs<\/a> by the government of the United States of America by virtue of United States treaties and not <a href=\"http:\/\/hawaiiankingdom.org\/treaties.shtml\">treaties<\/a> between the Hawaiian Kingdom and these foreign States.<\/p>\n<p>In 2003, the United States of America through its political subdivision, the <a href=\"https:\/\/portal.ehawaii.gov\/government\/\">State of Hawai\u2018i<\/a>,\u00a0<a href=\"http:\/\/lrbhawaii.info\/reports\/legrpts\/psd\/2005\/act200_58_slh03_05.pdf\">allocated<\/a> funding to transfer up to 1,500 prisoners to private corrections institutions in the United States of America. By June of 2004, there were 1,579 Hawai\u2018i inmates in these facilities. Although the transfer was justified as a result of overcrowding, the government of the State of Hawai\u2018i did not possess authority to transfer, let alone to prosecute in the first place.
